Man kills intruder breaking into home

 

MIDWEST CITY, Okla. -- Midwest City police are investigating what they are calling a justifiable homicide. Police say it was just before 8 a.m. Thursday when they got a call of a shooting in the 300 block of Kendra, near Reno and Douglas.

When they arrived the man who lived in the home told police a suspect was breaking in to his home when he shot him.

Midwest City Police Chief Brandon Clabes says, "He heard his dog growl and then heard two kicks at the front door."

The man went to check it out and found a man police say was armed coming in to his home.

Police say the man shot the suspect in the chest and called police.

The suspect was transferred to a nearby hospital where he died a short time later.

Dan Stephens' brother in law was the one who shot the intruder.

Stephens says, "Don't know where he came from. He said he didn't even see his face."

Police say while this is a homicide, it is justified under Oklahoma's "Make My Day" law.

Chief Clabes says, "By Oklahoma law, you have the right to protect yourself if you feel your life is in danger and this was a burglary in progress."

Police have not yet released the name of the suspect who was shot.
